The Ditsy
Terms of Use
Welcome to The Ditsy. These terms set out the agreement between you and us when you use theditsy.com or submit to be featured. Please read them carefully. By using the site or submitting to us, you agree to these terms.
The Ditsy is operated by Fiona Johnston, an individual based in New York, United States. If you have any questions about these terms, please email hello@theditsy.com.
What The Ditsy is
The Ditsy is a small editorial publication featuring independent makers of handmade children's goods. We are not a marketplace. We do not sell products. We do not process payments. We do not facilitate transactions between makers and readers. When you click a link from theditsy.com to a maker's Etsy shop, Instagram account, or other site, you leave The Ditsy and enter a separate site governed by that site's own terms.
Using the site
You may read, share, and link to content on theditsy.com for personal, non-commercial purposes. You may not:
- Copy or republish our editorial content (writing, design, layout) without permission
- Scrape or systematically harvest content from the site
- Use the site or its content in a way that violates any law
- Misrepresent yourself or impersonate anyone else when contacting us or submitting
If you'd like to quote or reference our content in an editorial context, please email us — we're generally happy to grant permission with credit.
Submitting to be featured
Anyone can submit themselves to be considered for a feature by filling out the submission form on theditsy.com. Submissions are governed by The Ditsy's Submission Agreement, which you agree to as part of submitting. By submitting, you confirm and agree to the following in summary:
- You are who you say you are. The information you provide is accurate, and the work you describe is your own.
- You're at least 18. Submissions are for adults only.
- We decide what to feature. Submitting does not guarantee a feature. We have full editorial discretion over what we publish, when, and how. We may decline any submission for any reason.
- You grant us permission to use your publicly posted Instagram photographs on The Ditsy's Instagram account and in editorial features on theditsy.com, with credit to you, if we choose to feature you. Full details are in the Submission Agreement.
- You confirm you have the rights to the photographs we may use, including any necessary consents from people pictured.
- Editorial framing is ours. We write about your work in our own voice, with reasonable accuracy.
- We may remove features at any time. You may also ask to be removed at any time by emailing hello@theditsy.com.
Our editorial content
The editorial content on theditsy.com — our writing, the way we present featured makers, the site's design and layout — belongs to The Ditsy. You may not republish it without permission.
Makers' own content — their photographs, their products, their business — belongs to them. We use it under the license granted in the submission process or as otherwise agreed.
No endorsement, no warranty
Featuring a maker is editorial coverage, not an endorsement of their products or business practices. We don't inspect, test, or vet products. We can't guarantee the quality, safety, or accuracy of anything sold by a featured maker. If you buy something from a maker we've featured, that's a transaction between you and them, and we're not part of it.
The site is provided "as is." We try to keep it accurate and online, but we don't promise it will always be available or error-free.
Limitation of liability
To the fullest extent permitted by law, The Ditsy and its operator are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site or from anything you do based on content you read here, including any transactions you enter into with featured makers. Nothing in these terms limits liability for anything that cannot be limited by law (for example, fraud or willful misconduct).
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in New York.
Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top will reflect any changes. If we make material changes, we will note them on the site. Your continued use of the site after a change means you accept the updated terms.
